AURASKA (“Website”) is an online selling channel having its registered office at E1, Second Floor, Vipul World, Sohna Road, Sector 48, Gurgaon, Haryana-122018.
AURASKA Retails LLP is the licensed owner of the brand AURASKA and the website auraska.com. As a visitor to the Site/ Customer you are advised to please read the Term & Conditions carefully. By accessing the services provided by the Site you agree to the terms provided in this Terms & Conditions document.
For the purposes of these Terms of Use, the term ‘AURASKA’ or ‘Us’ or ‘We’ refers to AURASKA Retails LLP. The term ‘You’ refers to the user or visitor of the Website. When You use our services, You will be subject to the terms, guidelines and policies applicable to such service and as set forth in these Terms of Use. As long as you comply with these Terms of Use, We grant You a personal, non-exclusive, non-transferable, limited privilege to enter and use our Site and services.
Registration
All customers have to register and login for placing orders on the Site. You have to keep your account and registration details current and correct for communications related to your purchases from the site. You will be required to enter Your personal information including Name first and last name, email address, mobile phone number and contact details, Postal code, Demographic profile (like your age, address etc.) while registering on the Platform.
By agreeing to the terms and conditions, the customer agrees to receive promotional communication and newsletters upon registration. The customer can opt out either by unsubscribing in “My Account” or by contacting the customer service. You agree and accept that as on the date of Your registration on the Site, the information provided by You is complete, accurate and up-to-date.
If You provide any information that is untrue, inaccurate, not current or incomplete, or AURASKA has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete AURASKA reserves the right to suspend or terminate Your Account and refuse any and all current or future use of the Site (or any portion thereof) at any time.
Eligibility
Services of the Site would be available to only select geographies in Haryana, New Delhi, Bihar and Jaipur. Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872 including un-discharged insolvents etc. are not eligible to use the Site. If you are a minor i.e. under the age of 18 years but at least 13 years of age you may use the Site only under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Use.
If your age is below 18 years your parents or legal guardians can transact on behalf of you if they are registered users. You are prohibited from purchasing any material which is for adult consumption and the sale of which to minors is prohibited.
Cancellation by Site / Customer
The order would not be cancelled once shipped for delivery. It is to be noted that You may have to pay a cancellation fee for transactions initiated on the Platform for which work has already been commenced by the Delivery Partner/Third Party Delivery Provider.
If we suspect any fraudulent transaction by any customer or any transaction which defies the terms & conditions of using the website, we at our sole discretion could cancel such orders. We will maintain a negative list of all fraudulent transactions and customers and would deny access to them or cancel any orders placed by them.
AURASKA may cancel the transaction initiated by You on the Platform, if:
(i) The designated address provided by You is outside the delivery service zone of AURASKA.
(ii) Information, instructions and authorisations provided by You is not complete or sufficient to execute the delivery service.
- If a Delivery Partner is not available to perform the services, as may be requested.
- If any Item for which You have initiated the transaction is not in stock.
- If the transaction cannot be completed for reasons not in control of AURASKA.
Return & Refunds
We offer 7 days hassle-free returns and exchange from the date of delivery and a further 5-7 days for the returned product(s) to reach us. We also offer reverse pick-up services. A reverse shipment fee of Rs.100 will be deducted at the time of refund per order, regardless of the number of items within that order. This means that if an order contains multiple items, only a single deduction of Rs.100 will be made for the entire order, not on each individual clothing item.
Pick-up will be attempted twice. If the courier company is unable to pick up the shipment, You will have to send the shipment back to the company address. Reverse pick-up is subject to the availability of the service in your area pin code.
Please return your product(s) in the same condition as it was shipped. If the products are returned in poor condition or have clearly been worn, a refund would not be provided.
Acceptance of returns & refund post-delivery is subject to a satisfactory inspection by our customer service team. Please get in touch with us for any queries.
You Agree and Confirm
(i) That in the event that a non-delivery occurs on account of a mistake by you (i.e. wrong name or address or any other wrong information) any extra cost incurred by AURASKA for redelivery shall be claimed from you.
(ii) That you will use the services provided by the Site, for lawful purposes only and comply with all applicable laws and regulations while using and transacting on the Site.
(iii) You will provide authentic and true information in all instances where such information is requested of you. AURASKA reserves the right to confirm and validate the information and other details provided by you at any point of time. If upon confirmation your details are found not to be true (wholly or partly), it has the right in its sole discretion to reject the registration and debar you from using the Services without prior intimation whatsoever.
(iv) You authorise AURASKA to contact you for any transactional purposes related to your order/account.
(v) That you are accessing the services available on this Site and transacting at your sole risk and are using your best and prudent judgment before entering into any transaction through this Site.
(vi) That the address at which delivery of the product ordered by you is to be made will be correct and proper in all respects.
(vii) That before placing an order you will check the product description carefully. By placing an order for a product you agree to be bound by the conditions of sale included in the item’s description
User Account, Password and Security
In order to use the Site, You will have to register on the Site and create an account with a unique user identity and password (“Account“).
You will be responsible for maintaining the confidentiality of the Account information, and are fully responsible for all activities that occur under Your Account. You agree to:
(i) immediately notify AURASKA of any unauthorized use of Your Account information or any other breach of security, and
(ii) [ensure that You exit from Your Account at the end of each session.] AURASKA cannot and will not be liable for any loss or damage arising from Your failure to comply with this provision. You may be held liable for losses incurred by AURASKA or any other User of or visitor to the Platform due to authorized or unauthorized use of Your Account as a result of Your failure in keeping Your Account information secure and confidential. Use of another User’s Account information for using the Platform is expressly prohibited.
You may not use the Site for any of the following purposes:
(i) Disseminating any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material.
(ii) Transmitting material that encourages conduct that constitutes a criminal offence or results in civil liability or otherwise breaches any relevant laws, regulations or code of practice.
(iii) Gaining unauthorized access to other computer systems.
(iv) Interfering with any other person’s use or enjoyment of the Site.
(v) Breaching any applicable laws;
(vi) Interfering or disrupting networks or web sites connected to the Site.
(vii) Making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner.
Modification of Terms & Conditions of Service
AURASKA may at any time modify the Terms & Conditions of Use of the Website without any prior notification to you. You can access the latest version of these Terms & Conditions at any given time on the Site. You should regularly review the Terms & Conditions on the Site.
In the event the modified Terms & Conditions is not acceptable to you, you should discontinue using the Site. However, if you continue to use the Site you shall be deemed to have agreed to accept and abide by the modified Terms & Conditions of Use of this Site.
Modification to the Service and Prices
Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
Accuracy of Billing and Account Information
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
